Contract Suspension

 

It is a temporary condition for the employment contract in which the employee's obligation to provide the service and the employer's obligation to pay the salary are suspended. Its main causes are:

Leave or temporary permit given by the employer to the employee or because of disciplinary suspension.
Military service summons. In such case, the employer must keep the employee's position for up to 6 months after the employee has been released from military service. After this period, if the employee has not returned to the company, the obligation to be returned to the position ceases.
Declared strike with full compliance to legal formalities.

The employment contract suspension period may be deducted when paying vacations, redundancy/dismissal or retirement.

Even if the employee is not currently working, the company must pay the corresponding social contributions, that is, it must process the employee's information in the payroll.

The suspension is not considered for vacation consolidation or redundancy/dismissal calculations, but it must be considered for all other cases, such as premiums for services rendered.

For non-obligatory premiums, it is the company's choice to continue to pay or not.

This is controlled by the type of absence, classified as Contract Suspension.
